Bowler v. Lockyer
The anti-gay group Campaign for California Families (CCF) submitted a proposed initiative to amend the California Constitution to permanently exclude same-sex couples from the right to marry and to eliminate the rights and responsibilities provided to registered domestic partners. After the Attorney General issued its description of the proposed initiative and its effect, CCF filed a lawsuit challenging the Attorney General's description. Sacramento Superior Court Judge Cadei resoundingly rejected CCF's claims, holding that the Attorney General's Title and Summary was accurate. The California Court of Appeal subsequently denied CCF's request to review the trial court decision. NCLR, the law firm of Remcho Johansen and Purcell, Lambda Legal, and the ACLU represent Equality for All, Equality California, and two same-sex couples.
